Embakasi East MP Paul Ongili alias Babu Owino will face the law over the alleged misuse of a firearm at a nightclub in Kilimani, Nairobi, in January 2020.
Milimani Senior Principal Magistrate Bernard Ochoi on Tuesday ruled that the lawmaker has a case to answer. He stands accused of disorderly conduct and firing a bullet with the intention to harm Felix Orinda, also known as DJ Evolve, while in possession of a firearm on the night of January 17, 2020, at B-Club.
Magistrate Ochoi ruled that the prosecution had adduced enough evidence to put Babu Owino on his defense.
The court at the same time rejected the MP’s claim that the prosecution had failed to discharge the burden of proof.
According to the prosecution, Babu Owino violated Sections 33 and 31 (1) of the Firearms Act. The penalty for one found guilty is imprisonment for a term not exceeding one year, or a fine not exceeding Sh10,000, or both.
The defence hearing is scheduled to start on June 15, 2023.
