It’s 3 Years in Jail for Prison Warder Who Killed KU Student in Hit and Run

July 2, 2019

A prison warder who hit a 22-year-old varsity student with his car on Mombasa road and dumped her body in South C will spend the next three years in jail.

Senior resident magistrate Elector Riany found that ex-Sergeant Dismas Motogwa Gitenge caused the death of Maureen Wambui Gachagua in July of last year through careless driving.

The magistrate on Monday also noted that the prison cop failed to stop at the scene of the accident and lied to the police by telling them he had hit a cow.

Riany said the accused’s actions warrant a custodial sentence after his lawyer Danstan Omari last week asked the court to grant his client a non-custodial sentence.

The Court further handed Mr Motogwa a six months jail term for failing to report the incident. Magistrate Riany also revoked his driving licence.

After hitting the deceased who was a Kenyatta University student, the suspect drove away with her mutilated body on the roof of the vehicle for three kilometres and dumped it at a turn near Car Max dealers in South C.

The deceased’s mother attempted to commit suicide following the loss of her last born daughter. The family said they are happy that “justice has been done”, Nation reports.

The prison warder’s lawyer Mr Omari said he intends to appeal against the sentence which has no option of a fine.
