The Kenyan Anti-corruption Commission (EACC) has launched investigations into the anticipatory bail issued to Kiambu Governor Ferdinand Waititu last Thursday.
The Ethics and Anti-corruption Commission said it received information that the bail was issued by a magistrate who was on sick leave.
Reportedly, Chief Magistrate Brain Khaemba stationed at Kiambu Law Courts reportedly terminated his sick off, showed up to court and granted Waititu the bail before going back on leave.
In a letter dated Wednesday, May 29, the commission asked the Judicial Service Commission (JSC) to investigate the magistrate over the allegations.
“The fact of the magistrate having to break his sick off, if indeed true, to come and attend on a specific matter, when there were other judicial officers who would have handled the matter may be an indicator the magistrate had an interest,” stated EACC.
Magistrate Khaemba was also accused of violating the constitution by issuing the anticipatory bail which could only be granted by the High Court.
Waititu was arrested by EACC detectives last Thursday and later released after securing KSh500, 000 anticipatory bail.
