Brian Mwenda, the infamous fake lawyer accused of impersonating a High Court advocate, has been released on a Ksh200,000 cash bail.
Chief Magistrate Lukas Onyina, sitting at the Milimani Law courts in Nairobi, ruled that the prosecution had not presented compelling reasons to deny bail to the accused.
The prosecution had urged the court to deny Mwenda bail, contending that if released, he might not appear for court proceedings.
The court also heard that Mwenda’s behavior indicated a lack of respect for the law, given that he allegedly evaded the police for over four days.
But through his lawyers, John Khaminwa and Danstan Omari, Mwenda argued that the accusations suggesting he might abscond court proceedings are untrue. He claimed that he has no motive to leave the country.
Mwenda was last Wednesday charged with creating a fraudulent certificate for admission to practice law as an Advocate.
The fake lawyer pleaded not guilty to six charges, including making a false document, uttering a false document, and identity theft.
The case will be mentioned on November 7, 2023.
Mwenda allegedly accessed the Law Society of Kenya (LSK) portal and manipulated the account details of an individual with the same name. He reportedly uploaded his own picture and falsely claimed to be trained in law.
The real lawyer, Brian Mwenda Ntwiga, contacted the LSK when he encountered difficulties accessing his account and discovered that certain details had been altered.
