Senator Linturi Asks Court For his Money Back in Attempted Rape Case

Meru Senator Mithika Linturi has asked the court to compel the prosecution to release the money he gave to the complainant he allegedly attempted to rape.

Linturi appeared at the Milimani Law Courts in Nairobi on Thursday for a pre-trial session of the case.

Through his lawyer Muthomi Thiankolu, the Senator argued that the State has been holding his money amounting to Sh200,000 for the last year.

Linturi had sent the money to the complainant in a bid to settle the matter out of court.

In her statement, the complainant indicated that Linturi offered her Sh200,000 in cash and a Sh800,000 cheque but later reported her for extorting him.

“Your honour, I am making an application to have the prosecution release Sh200,000…the said money belongs to my client and was recovered from the complainant by the police,” said the lawyer.

In response, prosecutor Alice Mathangani told chief Magistrate Susan Shitubi that the Sh200,000 will be used in court as evidence and thus cannot be released.

Speaking to the media after the session, Linturi asked the Director of Public Prosecutions (DPP) Noordin Haji to supply the documentary evidence to expedite his case saying he wants to see his accuser.

“I want to appeal to the Director of Public Prosecutions to supply the evidence in this matter. I don’t want any more adjournment by the state. I want to see the lady I’m accused of touching and attempting to rape,” Linturi said

Linturi also asked the media to provide enough coverage of the rape case saying the case is politically motivated. He noted that he wants to clear his name before the 2022 general elections.

The magistrate ordered that the matter be mentioned after two weeks.
