Lawyerless and in Fear, Ndiang’ui Appeals to Court for Extended Protection

July 25, 2025

Blogger Ndiang’ui Kinyagia has pleaded with the High Court to protect him from a possible arrest, saying he fears for his life if taken into police custody.

During a Thursday court session, Ndiang’ui personally appealed to Justice Chacha Mwita to extend the protection orders previously granted in his case.

His emotional plea came after he volunteered to provide an explanation of what transpired during his absence. Flanked by his mother, Ndiang’ui told the court that he is ready to give his version of events and shed light on what occurred during his absence.

The session also saw another development in the case: the Law Society of Kenya (LSK), which had been representing Ndiang’ui, officially filed a notice to withdraw from the case. This left him temporarily without legal counsel.

Despite the setback, Ndiang’ui informed the court that lawyers Wahome Thuku and Kibe Mungai would represent him from then on. He also requested the court to adjourn so that he could read the court files and prepare adequately.

However, the respondents, through counsel Marwa, objected to any adjournment. They argued that the case had already dragged on for too long and warned that adjournments would postpone justice and leave the public in the dark.

Justice Mwita, in his ruling, gave Ndiang’ui 14 days to appoint legal representation and file an affidavit on the events that culminated in his disappearance.

“At the same time during the said period, you have to file an affidavit explaining what you know and what happened because this court and the people of Kenya deserve to know the truth,” Justice Mwita said.

The case will continue on September 16, 2025.
