#FreeBonifaceMwangi Trends as Activist Faces Controversial Terror-Related Charges

Outspoken human rights activist Boniface Mwangi is facing serious allegations of “facilitating terrorist acts” during last month’s nationwide anti-government protests. The claims emerged on Sunday, after police arrested Mwangi at his home in Lukenya, Machakos County.

The arrest follows the June 25 protests against President William Ruto’s administration that escalated into violence and left at least 19 people dead. The protests took place as the nation was commemorating the one-year mark of a similar protest last year that was to commemorate victims of police brutality.

Detectives who arrested Mwangi reportedly seized two mobile phones, a laptop, and several notebooks. He was later taken to his office at Mageuzi Hub on Rose Avenue in Hurlingham, Nairobi, where police carried out a search.

According to investigators, the search yielded nine assorted external hard drives, two additional laptops, company seals for Brave Media Ltd and Courage Ltd, a company stamp, six cheque books, stamp duty documents, two unused tear gas canisters, and one 7.62mm blank round.

Mwangi was subsequently taken to Pangani Police Station, where he is in detention. The Directorate of Criminal Investigations (DCI) confirmed via X (formerly Twitter) that he will be brought to court today( Monday, July 21).

Mwangi, however, vehemently denied the allegations. In a social media post by his followers, he declared, “I am not a terrorist.”

His arrest has stirred up a storm of indignation on social media, with the #FreeBonifaceMwangi hashtag trending as thousands rallied to his defense.

Mwangi’s legal team also came out strongly against the charges and the manner in which the arrest and subsequent searches were conducted. Led by advocate Njanja Maina, the team accused police of planting evidence to build a false terrorism case.

“We have seen a statement by the DCI today that there are items that were picked from his office. We can confirm and state with no uncertainty that those are things which he did not have in his possession. So we do not know why they are coming up with terrorism charges,” Maina said outside Pangani Police Station on Sunday.

The legal team further accused the authorities of violating the terms of the court order authorizing the search. While police had secured an ex parte order to search Mwangi’s office, Maina said they also searched his home, even though no arrest warrant had been issued at the time.

“Boniface Mwangi was picked from his residence at around 4pm and brought to his office, where officers had obtained an ex parte order. The search warrant was exclusive to his office, but we can also confirm that they searched his home. ,” said advocate Njanja Maina. “We don’t know why this was done, especially since there was no arrest warrant accompanying the order.”

She added that Mwangi was being held on a “holding charge” as investigations continued, and assured the public that he was in good health and cooperating fully with the authorities.
