A 26-year-old business woman will spend 15 years behind bars for defiling a 17-year-old minor.
Jane Gichuhi was accused of intentionally defiling the Form 3 student on diverse dates between April 26, 2015 and May 11, 2015 at Machinjoni area in Trans Nzoia County.
The student at Friends Bwake Secondary school in Kitale town told the court that the accused lured him into the sexual act after befriending him.
The prosecution team told the Kitale Law Court that the suspect, a maize trader, would take the boy for outings during holidays, before luring him into sex.
In May 2015, however, the boy failed to report to school, prompting the school to call his parents.
The two were later traced to a bar.
“The parents started tracing the boy and found him in a bar drinking beer. When taken to Endebess police station, he confessed that the woman has been defiling him for several occasions during holidays,” the court heard.
The boy further confessed that the woman would pay for his back to school shopping and give him pocket money.
In her ruling, Kitale resident magistrate Grace Sitati, said that the court had considered all the evidence before it and concluded that the businesswomen had pre-meditated and executed the offence.
In her mitigation, the accused pleaded for leniency saying she is sickly and also a mother to a young child. She added that she is the sole breadwinner and has a lot of debts which she needs to settle.
The court said that it had considered the woman’s pleas, but was left with no option but to hand over the sentence to deter others with similar intentions.
“The mitigation by the accused is considered. However in view of the limitation in sentencing under the section 8(4) of Sexual offences Act, I must meme down the minimum sentence or above. Doing the best I can do is to sentence the accused for 15 years imprisonment. She has the right of appeal within 14 days,” said the magistrate.
