Kiambu County governor William Kabogo has lost a bid to stop Kabete MP Ferdinand Waititu from contesting in 2017 over his alleged fake academic credentials.
High Court judge Justice Joseph Onguto, in his ruling on Wednesday, agreed with arguments put forward by the Kabete legislator’s legal counsel Harrison Kinyanjui that it has no jurisdiction to determine the matter.
Kabogo had moved to court saying he has evidence that his political rival Ferdinand Waititu, holds a fake academic degree from Punjab University in India.
The governor wanted Waititu barred from holding any public office on grounds that he had breached the Leadership and Integrity Act.
Kabogo’s suit took a dramatic twist in April after KNEC filed a document in court claiming the Kiambu Governor had submitted forged documents in his case against Kiambu County gubernatorial hopeful.
Justice Onguto on Wednesday said the EACC has been tasked to investigate issues of integrity and leadership raised by Kabogo, hence any determination by the court on the same would amount to interference with their mandate.
